By accessing or using EmailCheck (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

EmailCheck provides email deliverability checking services, including but not limited to:

• SPF, DKIM, and DMARC record validation
• Domain reputation scoring
• Blacklist scanning
• Email configuration analysis and recommendations

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms of Service or engage in fraudulent, abusive, or illegal activities.

4. Subscription Plans and Billing

EmailCheck offers both free and paid subscription plans:

• Free Plan: Limited to 5 domain checks per month with basic features
• Paid Plans: Billed monthly or annually with varying check limits and features

By subscribing to a paid plan, you agree to pay all fees associated with your chosen plan. All fees are non-refundable except as required by law or as explicitly stated in our refund policy (14-day money-back guarantee). Subscriptions automatically renew unless canceled before the renewal date.

All payments are processed by Lemon Squeezy, our Merchant of Record. Lemon Squeezy handles billing, invoicing, tax compliance, and refunds on our behalf. By making a purchase, you also agree to Lemon Squeezy's Terms of Service.

5. Usage Limits and Restrictions

You agree not to:

• Exceed the usage limits of your subscription plan through automated means or abuse
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to send spam, malicious content, or engage in illegal activities
• Share your account credentials with third parties or create multiple accounts to circumvent usage limits
• Interfere with or disrupt the Service or servers/networks connected to the Service

We reserve the right to enforce these restrictions through technical means and to suspend or terminate accounts that violate these terms.

6. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software, are the exclusive property of EmailCheck or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

7. Data Accuracy and Liability

While we strive to provide accurate and up-to-date information, EmailCheck does not guarantee the accuracy, completeness, or reliability of any results provided by the Service. Email deliverability depends on numerous factors beyond our control. You are solely responsible for verifying any information and for any decisions made based on the Service's results. We are not liable for any damages arising from the use or inability to use the Service.

8. Limitation of Liability

To the maximum extent permitted by law, EmailCheck and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless EmailCheck and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to protect intellectual property rights.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
